Welcome to UrUsed.com. These Terms and Conditions (“Terms”) govern your access to and use of our website and services (collectively, the “Platform”), where users can post and selling all your used goods, no matter they are Old or New. By accessing or using our Platform, All policies, the Mobile Devices Terms, and the Privacy Policy are incorporated into these Terms of Use. You agree to comply with and be bound by these Terms. If you do not agree, please do not use our Platform.
By using the Services, you agree that your ads can be displayed on those other sites. The terms for our global sites are similar to our terms here, however you may be subject to additional laws or other restrictions in the countries/ locations where your ad is posted. When you choose to post your ad to another site, you may be responsible for ensuring that it does not violate our other site policies. We will remove your ad if it is flagged on any of our sites, or otherwise we find it causes problems or violates any law or policy.

Our posting service is 100% free for users that are posting used goods. Therefore, please be aware that urused.com and it’s team members will never ask your Bank account information, your Banking password, your phone numbers, credit cards/ gift cards number that are belong to you. Nor your home Address, Date of birth, or any personal private, sensitive information that may associated to your financial activities. If anyone that is acting on behalf of this matter, that is a SCAM! Please report to us immediately, and be aware to not release any personal information. 

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use our services. By using our Platform, you represent that you meet this requirement.

2. Account Registration

To post or contact other seller, and manage your post images and contact information, you may need to create an account.

You are responsible for maintaining the confidentiality of your account information and for all activities under your account.
You are solely responsible for maintaining the confidentiality of your password, for all activities that occur under your Account, and protect your password and make your password difficult for others to guess. You will not transfer your Account to another party without our consent.

You agree to provide accurate and up-to-date information.
You may connect to the Services with a third-party service and you give us permission to access, store, and use your information from that service as permitted by that service and as may be described in our Privacy Policy. If you believe your Account may have been compromised or misused, contact us immediately at UrUsed Customer service Dept, email: info@urused.com

Personal Information. By using Services, you agree to the collection, transfer, storage and use of your personal information by UrUsedCanada Ltd. (the "data controller") on servers located in the United States as further described in our privacy policy.

3. User Content and Listings

You are solely responsible for the content you post, including descriptions, images, and prices of items.

You agree that your listings:

Must be truthful and accurate.

Must not violate any law, infringe on any third-party rights, or include prohibited items.

Must not contain misleading, false, or offensive content.

We reserve the right to terminate our services, or remove any listing that violates these Terms or our policies. And take technical and legal steps to keep such user off from using UrUsed.com if we determine that they have created problems or act inconsistently with the letter or spirit of our policies.
Please use contact us for any problems or offensive content so that together we can keep the UrUsed.com working properly.
However, if we decide to take any of these steps, remove hosted content or keep a user off UrUsed.com or not, we do not accept any liability for monitoring UrUsed.com or for unauthorized or unlawful content on UrUsed.com.

When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. You agree not to copy, modify, resell or distribute the Services, our copyrights or trademarks.

4. Prohibited Items

Users are not allowed to post or sell:

• Illegal goods or stolen property.
• Weapons, drugs, or hazardous materials. Alcohols that are prohibited by Government of Canada, Cigarets, Cigars, Vaping materials, Cannabis, Marijuana, and any illegal materials good that are prohibited from Government of Canada and Federal Government of United States of America. 
• Counterfeit or trademark-infringing items.
• Items that violate local laws or community standards.
• A full list of prohibited items may be found in our Prohibited Items Policy (if applicable).
• Distribute viruses or any other technologies that may harm UrUsed.com or the interests or property of UrUsed.com users.
• Impose an unreasonable load on our infrastructure or interfere with the proper working of our site, with its technology of UrUsed.com.
• Use of robot, spider, scraper or other automated means to access UrUsed.com and collect content for any purpose without our express written permission.
• Copy, modify, or distribute any other person's content.
• Harvest or collect information about others', including email addresses, without others’ consent;
• Bypass measures used to prevent or restrict access to UrUsed.com
• Abusing UrUsed Services.

5. Transactions and Payments

UrUsed.com does not own or sell any of the items listed by users.

We act only as a platform connecting buyers and sellers.

Users are responsible for arranging payment, shipping, and item delivery.

We are not responsible for disputes, losses, or damages resulting from user transactions.

You agree to comply with all applicable laws and regulations in respect of any purchase your ultimately make from a seller through UrUsed.com, including any licensing and/or insurance requirements for vehicle that are posted on UrUsed.com 

6. Seller/Poster Tax liability, and User Conduct

You are fully responsible to collect and remit any applicable taxes where result from the sales of items or services that you earned from UrUsed.com.

You agree NOT to:

Post spam, fraudulent, or misleading content.

Harass, abuse, or harm other users.

Use the Platform for unlawful purposes.

Attempt to hack, scrape, or disrupt our services.

7. Advertising Fees (apply to business/ individuals who post Advertising banners on our site)
Our Advertising fees are non-refundable, and you are responsible for paying them when they're due. If fees are not paid before due dates, your ability to use our Advertising Services will be limited. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.

Canadian and USA taxes associated with Advertising Services would be collected whenever it’s applicable. 

You agree to provide accurate postal code information necessary for UrUsed.com to comply with its obligations under applicable law. To the extent that such information is not provided, UrUsed.com will in its discretion determine and collect appropriate taxes.

Our Advertising fees are non-refundable, and you are responsible for paying them when they're due. If fees are not paid before due dates, your ability to use our Advertising Services will be limited. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.

Canadian and USA taxes associated with Advertising Services would be collected whenever it’s applicable. 

The UrUsed Digital Retailing Solution may not be available for all vehicle listings. The UrUsedDigital Retailing Solution may be subject to additional requirements as set out in the UrUsedDigital Retailing Solution.  

8. Intellectual Property

All content, branding, and design on UrUsed.com belong to us or our licensors. You may not copy, modify, or distribute any part of our Platform without permission.

9. Disclaimer of Warranties

Our Platform is provided “as is” and “as available.”
We make no warranties or representations about the accuracy or reliability of any listings, user content, or third-party services.

10. Limitation of Liability

To the maximum extent permitted by law, UrUsed.com shall not be liable for:

Any loss or damage resulting from transactions between users.

Any indirect, incidental, or consequential damages.

Any unauthorized access to your data or account.
As most of the stuff on UrUsed.com come from other users, we do not guarantee the accuracy, completeness, efficacy or timeliness of any postings or user communications or the quality, safety, or legality of what is offered. We also cannot guarantee continuous or secure access to our Services.

Notification functionality in our site may not occur in real time. Such functionality is subject to delays beyond our control, including but not limited to delays or latency due to your physical location or your wireless data service provider’s network. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of UrUsed.com
Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Canadian Dollars.

Indemnification. You will indemnify and hold harmless UrUsed.com and its affiliates and our and their respective officers, directors, agents and employees (each an “Indemnified Party”), from any claim made by any third party, together with any amounts payable to the third party whether in settlement or as may otherwise be awarded, and reasonable legal costs incurred by any of the Indemnified Parties, arising from or relating to your use of the Services, any alleged violation by you of the applicable terms, and any alleged violation by you of any applicable law or regulation. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, but doing so will not excuse your indemnity obligations.
General. These terms and its policies posted on the Services constitute the entire agreement between us and you, superseding any prior agreements. This agreement is. If we don't enforce any particular provision, we are not waiving our right to do so later. By using our site, you automatically assign this agreement in a good faith of using our site, following the Terms and Conditions there by.

11. Termination

We may suspend or terminate your account if you violate these Terms or engage in fraudulent, harmful, or unlawful behaviour.

12. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page with the updated “Last Updated” date. Continued use of our Platform means you accept the revised Terms.
Any updates taking effect when you next use the site or after 30 days, whichever is sooner.

13. Governing Law

These Terms governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein without regard to conflict of law principles. For USA sites which may apply to special States, please refer to Local Laws and regulations, for example as state of California, USA. 

14.Global site of UrUsed.com 

Without any limitation, to the rights granted, some of UrUsed.com features may display your ad on other sites that are part of our classified sites in other countries. 

We will notify you of changes to our Terms and Conditions by posting such changes on the site. 

15. Third Party Advertising Post and Data collection
Our site may contain Third-Party Advertising tailored for a second-hand goods website that allows outside advertisers or ad networks (e.g., Google Ads, affiliate banners, sponsored posts) to display advertisements on the platform.

These Third-Party Advertising Terms and Conditions (“Terms”) govern the placement, display, and management of third-party advertisements (“Ads”) on UrUsed.com (“we,” “our,” or “us”).
By submitting, purchasing, or displaying Ads on our website or associated digital properties (the “Platform”), the advertiser (“you” or “Advertiser”) agrees to these Terms.

a. Acceptance of Terms

By purchasing or placing Advertisement through UrUsed.com, you confirm that: You have read, understood, and agreed to these Terms.

You are authorized to act on behalf of the business or entity you represent.

If you do not agree, do not submit or display Ads on our Platform.

b. Advertising Eligibility

We reserve the right to approve, reject, or remove any advertisement at our sole discretion.
Ads may be declined if they:

Contain misleading, false, or deceptive claims

Promote illegal, counterfeit, or adult materials

Infringe on the rights of third parties (e.g., trademarks, copyrights)

Are offensive, discriminatory, or inappropriate for our audience

All Ads must comply with applicable local, state/provincial, and federal laws, and industry advertising standards.

c. Advertising Content and Responsibility

Advertisers are solely responsible for the accuracy, legality, and content of their Ads.

By submitting an Ad, you represent and warrant that:

You have all rights and permissions to use the text, images, logos, or trademarks contained in the Ad.

Your Ad does not infringe any intellectual property or privacy rights.

The goods or services you promote are lawful and genuine.

You agree to indemnify and hold harmless [Your Website Name], its owners, affiliates, and users from any claims, damages, or losses arising from or related to your Ads.

d. Placement and Display

Ad placement, size, and positioning on our Platform are determined by us, unless otherwise agreed in writing.

We do not guarantee any specific position, performance, or user engagement.

Ads may appear alongside other content, including competing offers or listings.

We may tag or label Ads as “Sponsored,” “Advertisement,” or “Promoted” to comply with transparency and advertising standards.

e. Payments and Billing

All advertising fees must be paid in accordance with the pricing and schedule agreed upon in your advertising order or agreement.

Payments must be made in full before the campaign begins, unless otherwise approved.

Failure to pay may result in suspension or removal of Ads.

Advertising fees are non-refundable, except where required by law or explicitly stated otherwise in writing.

f. Tracking and Analytics

We may provide general performance data such as impressions or click-through rates.

Any tracking technologies or cookies used in Ads must comply with applicable privacy laws (e.g., PIPEDA, CCPA, or GDPR, depending on user location).

Advertisers may not collect personal data from users without explicit consent and compliance with our Privacy Policy.

g. Third-Party Ad Networks

If we use third-party networks (e.g., Google Ads, Meta Audience Network) to display advertisements:

Their tracking, cookies, and privacy practices are governed by their own policies.

We are not responsible for the actions, data collection, or targeting methods of third-party ad providers.

Users may opt out of personalized advertising through those networks’ privacy settings or via browser-based ad preferences.

h. Prohibited Advertising Categories

The following types of advertisements are strictly prohibited:

Illegal or counterfeit products

Weapons, explosives, or drugs

Adult or sexually explicit material

Hate speech, harassment, or discrimination

Misleading “get-rich-quick” schemes

Malware, phishing, or any form of deceptive software

Violation of these restrictions may result in immediate removal and possible account suspension.

i. Limitation of Liability

To the fullest extent permitted by law:

UrUsed.com shall not be liable for any indirect, incidental, or consequential damages, including lost profits or business interruption.

We do not guarantee any minimum performance, conversions, or results from Ads.

Our total liability for any claim related to advertising shall not exceed the total amount paid by you for the specific Ad campaign in question.

j. Termination and Suspension

We may suspend or terminate your Ads or advertising account at any time, without notice, if:

You violate these Terms or applicable laws; or

We determine that your Ads could harm our reputation or user experience.

Termination does not release you from payment obligations already incurred.

k. Intellectual Property

All website content, structure, and design elements of UrUsed.com remain our exclusive property.
Advertising on our Platform does not grant you any rights to use our trademarks, logos, or branding without prior written consent.

l. Modifications

We may update these Terms from time to time. Any updates will be posted on this page with an updated “Last Updated” date.
Continued participation in advertising after such updates constitutes acceptance of the revised Terms.

m. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Government of Ontario, Canada, without regard to its conflict of law principles.
Any disputes shall be resolved in the courts located in Markham, Ontario, Canada.
